RULEBOOK ON ADVERTISING AND PRESENTATION OF THE TOURIST OFFER ON THE TOGS WEBSITE
I BASIC PROVISIONS
Article 1
This Rulebook governs the conditions, manner, and procedure for advertising and presenting the tourist offer on the website of the Tourist Organization of the City of Subotica (hereinafter: TOGS), the rights and obligations of applicants for advertising, as well as other matters of importance for publishing content of tourism significance.
Article 2
Advertising and presenting the tourist offer on the TOGS website aims to promote the City of Subotica as a tourist destination. The publication of content from individual entities is carried out solely in function of achieving this goal and does not constitute an entity's right to promotion, nor an obligation of TOGS to publish or retain any individual content. The TOGS website does not constitute a commercial advertising service, but rather an informative and promotional platform of public interest.
Article 3
For the purposes of this Rulebook, the following terms shall have the following meanings:
"TOGS Website" — the official internet presentation of the Tourist Organization of the City of Subotica.
"Tourist Entity" — a legal entity, sole proprietor, or natural person engaged in activities in the field of tourism, hospitality, culture, sports, or other services relevant to the tourist offer of the City of Subotica.
"Advertiser" — a tourist entity whose data or content is published on the TOGS website.
"Applicant" — a person who submits a request for publishing, modifying, or deleting content on the TOGS website on their own behalf or on behalf of a tourist entity.
"Content" — all text, photographs, graphic displays, logos, contact details, offer descriptions, and other materials submitted for publication on the TOGS website.
"Advertiser's Declaration" — an electronic statement provided by the applicant upon submitting a request, confirming the accuracy and legality of the submitted content and accepting the provisions of this Rulebook.
"Cooperation Agreement" — a contract concluded between TOGS and a tourist entity governing special terms of business cooperation.
Article 4
Advertising and presenting the tourist offer on the TOGS website is free of charge, except in cases of special promotional activities, campaigns, or other forms of cooperation. In such cases, the terms of cooperation shall be governed by a separate agreement concluded between TOGS and the entity.
II CONDITIONS FOR CONSIDERATION AND PUBLICATION
Article 5
Tourist entities and other service providers relevant to tourism may be presented on the TOGS website in accordance with the needs of promoting the tourist offer of the City of Subotica and in line with the editorial policy of TOGS.
Article 6
Meeting the conditions prescribed by this Rulebook does not create an obligation for TOGS to publish, retain, or update data regarding a specific entity. TOGS reserves the discretionary right to:
Independently decide on the selection, scope, manner, and timing of the presentation of tourist entities, taking into account the importance of the offer, the level of cooperation with TOGS, and available resources;
Reject a publication request, decline publication, or remove/suspend already published content at any time without prior notice. TOGS is not obliged to justify the reasons for rejection or removal of content, unless explicitly required by law.
Article 7
Only entities that fulfill the following criteria may be considered:
Operate in accordance with the applicable regulations of the Republic of Serbia;
Possess appropriate permits, decisions, registrations, or categorizations, if required by law;
Provide accurate and complete data regarding their operations;
Do not harm the reputation of TOGS, the City of Subotica, or the city's tourist offer with their content.
Article 8
Travel agencies may be advertised if they operate in accordance with the applicable regulations of the Republic of Serbia and provide tourist services relevant to users of the TOGS website. When deciding on publication, TOGS may consider the existence of programs, excursions, tours, or other tourism content related to the City of Subotica and its surroundings, as well as other forms of tourism offers and cooperation relevant to tourism promotion, in line with the goals, work program, and editorial policy of TOGS.
Article 9
Upon request by TOGS, tourist entities are obliged to submit proof of eligibility to perform business activities and other documentation in accordance with the law.
Article 10
For certain categories of the tourist offer, particularly accommodation services, TOGS may establish additional publication requirements. Natural persons operating accommodation facilities who do not have a valid agreement concluded with TOGS cannot be presented in the accommodation category. TOGS reserves the right to adjust the number, type, and selection of accommodation facilities to the promotional needs of the City of Subotica's tourist offer.
III METHOD OF SUBMITTING REQUESTS AND ADVERTISER'S DECLARATION
Article 11
Requests for publishing new content, or modifying/updating existing content on the TOGS website, shall be submitted exclusively via the electronic form available on the TOGS website. The electronic form includes the Advertiser's Declaration, data necessary for identifying the applicant, information on the tourist offer, statements and consents prescribed by this Rulebook, as well as the option to submit supporting documentation in electronic format. TOGS is not obliged to consider requests for publishing, modifying, or supplementing content that are not submitted in accordance with this Rulebook.
Article 12
The Advertiser's Declaration is provided exclusively via electronic means when filling out the electronic form on the TOGS website. By submitting the electronic form and confirming acceptance of this Rulebook, the applicant declares that:
They operate in accordance with the applicable regulations of the Republic of Serbia;
All submitted data is accurate, complete, and up to date;
They possess all necessary rights to use and publish the submitted material;
The submitted material does not infringe upon the rights of third parties;
They assume full responsibility for the submitted content and its legality;
They are authorized to submit the request on behalf of the advertiser, if not acting on their own behalf.
Submitting the electronic form shall be considered as providing the Advertiser's Declaration and accepting this Rulebook.
IV MANNER OF ADVERTISING
Article 13
Advertising is carried out on the TOGS website within categories corresponding to the type of tourist offer. Published data may include:
Entity name;
Description of the offer;
Contact information;
Photographs;
Website address;
Business hours;
Other information of interest to tourists.
Article 14
TOGS is under no obligation to decide on a submitted request within a specific timeframe. As a good host, TOGS will endeavor to consider submitted requests within a reasonable timeframe, taking into account available staffing, technical, and organizational capacity.
Article 15
TOGS reserves the right to make proofreading, linguistic, technical, graphical, and editorial changes to content without altering the essence of the submitted data, in order to adapt it to the website and standardize the presentation of the tourist offer. TOGS is not required to obtain special consent from the applicant for the aforementioned changes, unless such consent is mandated by law.
V CONDITIONS FOR REMOVAL AND REJECTION OF ADVERTISING
Article 16
TOGS reserves the right not to publish or to remove already published content if:
The applicant fails to submit a duly completed Declaration;
The content is found to violate the Law on Advertising, the Law on Copyright and Related Rights, or other applicable regulations;
The content contains inaccurate or misleading information;
The content damages the reputation of TOGS, the City of Subotica, or the city's tourist offer;
The content contains hate speech, discrimination, or other inappropriate material;
The content is not aligned with the objectives, work program, or editorial policy of TOGS.
TOGS may, but is not obligated to, inform the advertiser of the removal of content and the reasons thereof.
VI LIABILITY
Article 17
TOGS publishes data, photographs, and other information submitted by the applicant, subject to the right to make modifications in accordance with Article 15 of this Rulebook. TOGS does not verify the veracity of all submitted data and does not guarantee its accuracy, completeness, timeliness, or legality, except to the extent that such verification is possible and necessary to enforce this Rulebook. Full material, criminal, misdemeanor, and other liability for submitted data, documentation, photographs, and other materials, as well as for their legality, accuracy, and timeliness, rests solely with the applicant. TOGS bears no material, criminal, misdemeanor, or other liability (except to the extent that the obligation of control is explicitly prescribed by applicable laws) for:
Inaccuracy, incompleteness, or outdatedness of submitted data;
Advertiser's failure to fulfill obligations toward service users;
Quality, availability, or legality of services provided by the advertiser;
Any infringement of copyright and related rights;
Content, documentation, photographs, and other materials submitted by the applicant or third parties;
Any damage that may occur as a result of relying on data published on the TOGS website.
VII TRANSITIONAL AND FINAL PROVISIONS
Article 18
The provisions of this Rulebook apply to all legal entities, sole proprietors, and other individuals who submit a request for advertising or content modification after this Rulebook enters into force. This Rulebook does not apply retroactively to entities whose data has already been published on the TOGS website. Data published prior to the entry into force of this Rulebook shall be considered published for informational purposes and shall remain published in its existing form. Notwithstanding the above, TOGS reserves the right to apply Articles 6 and 16 of this Rulebook to these entities at any time and remove their content. Entities whose data was published before the entry into force of this Rulebook may submit a request at any time to modify or supplement existing content via the electronic form on the TOGS website.
Article 19
Entities whose data is published on the TOGS website have the right to request at any time:
Deletion of the advertisement;
Modification or update of the advertisement;
Termination of advertising.
Requests for modification, supplementation, or termination of data publication shall be submitted via the official electronic form on the TOGS website. Exceptionally, a request for content deletion may also be submitted in written form to TOGS headquarters address. TOGS is obliged to act upon a deletion request within 30 days of receiving a proper request. Any modification or addition to an existing advertisement shall be considered a new advertising request and requires acceptance of this Rulebook and submission of the Advertiser's Declaration.
Article 20
The statements and consents prescribed by this Rulebook constitute an integral part of the official electronic application form.
Article 21
The electronic form of the Advertiser's Declaration, accepted by the applicant by checking the corresponding box during submission, contains the following elements and statements:

DECLARATION
By submitting this declaration, I declare under full material, criminal, and misdemeanor liability:
1. That I conduct business activities in accordance with the applicable regulations of the Republic of Serbia.
2. That all submitted data is accurate, complete, and up to date.
3. That I possess all necessary rights to use and publicly publish the submitted text, photographs, logos, and other material.
4. That the submitted material does not infringe upon third-party rights, including copyright and related rights, intellectual property rights, and personal rights.
5. That I accept the Rulebook on Advertising and Presentation of the Tourist Offer on the TOGS Website.
6. That I assume full responsibility for the accuracy, legality, and timeliness of the submitted data and materials.
7. That I am authorized to submit the request on behalf of the advertiser, if not submitting on my own behalf.
